Having been involved in the odd copyright tussle on Youtube, honestly you guys aren't going to ever get rid of him going the way you're going. Takedowns can be pretty easily appealed, and unless you engage with Youtube then they're usually pretty happy to just give the schmo his account back.

Take his ass to court (even the tiniest of writs would do), I'd be glad to stand as a character witness.

You must be one of the lucky ones then, cos I have had some appeals rejected by the claimants (even with videos that fell under Fair Use!) which as a result has left some videos unplayable in places like Germany ("AMV Heaven Vol. 1" being one of them)

Bear in mind that Fair Use isn't really a set list of parameters. It has to be argued and decided upon. I don't know what it was that you had taken down, but there's every chance that it didn't actually qualify as 'Fair' in someone else's judgement.
