WELL, no, I know I sound like a lawyer but you can't just put loads of copyrighted stuff you youtube and use the fair use act. It's illegal.

The fair use act was set up so people filming in the street who pick up audio or music from a passing stereo or logos from billboards and stuff won't be sued. Posting 100's of videos on youtube is in no way fair use, its piracy / bootlegging.

That said, it was nice having everything in one place, it had all been shared here at one time or another, and a few bits were from the Freddie mercury box set ETC. But david r fuller has no legal comeback what so ever.

Your Channel with audience bootlegs MAY be allowed by queen productions / universal records, mainly because it will cost more to sue you than they will get from you, but if they wanted to, they could send a cease and desist because they own the music.

There's no profit involved. Plus Dave (and myself) upload these strictly for archiving purposes. We just want to SHARE (not steal or pirate) our audio collections.

Your motives are irrelevant.  These people think in legal terms.  Fair Use has given people a bit of grey area to play around with, as it is something that allows for a certain amount of flexibility, but that ultimately comes down to how convincing a legal argument you are able to make.  I hate to say it but neither you, me,  Dave R Fuller or anyone on this forum would appear to be fluent enough in legalese to go up against these scoundrels.

Accept the fact that your hobby basically amounts to screwing around with someone else's intellectual property.  As fans, we think it's great.  We enjoy hearing this rare stuff for free.  But on paper, it's not yours to be doing this with, and you are able to do it *purely* on the goodwill of those who own the property.

No, I'm definitely not an expert when it comes to law. But I have dealt with copyright nazis messing around with my video directing channel (the one where I make the Freddie wrestling matches). I have gotten my audio muted on a number of videos--but I've successfully disputed each one (claiming fair use).

In fact, my biggest problem with Dave's channel was that a FAKE company screwed his channel up!

Gotta agree with Sebastian.  Dave Fuller will be missed. Its a real shame.

Youtube probably didn’t give it much time or investigation, their system probably matched up the music to stuff in their database and flagged it, your “fair use” excuse unflagged it. It’s a simple threat from the big companies.
If a company got involved rather than a computer it probably wouldn’t hold up, and wouldn’t hold up if it ever went to court.

Doesn’t matter, some companies don’t mind as long as it’s not for profit, but it’s their choice not a legal requirement.

For example, paramount allow star trek fan stuff, the BBC allow doctor who fan stuff (even putting it as extras on DVD releases), the ‘members’ of spinal tap don’t mind and neil innes from the RUTLES and Monty python doesn’t mind his stuff uploaded.
As long as it’s given free, most have worked out it’s good free publicity, but they have no legal requirement to allow free distribution of anything they own.

As zebonka said in the unlikely event it happened, none of us know enough to fight it.

Exactly.  From personal experience, appealing on grounds of Fair Use will just about get your video immediately put back up, with audio and everything.  But if the owners personally review the video (instead of ignoring it like they usually do), then it will go down again just as immediately.  Another thing about Youtube is that a video that is 'blocked' on copyright grounds isn't much of a problem.  It's just a video that people can't watch.  If you keep appealing against these decisions, you can get yourself a Copyright Strike.  3 of those and your channel is history.  And they don't expire after 6 months like the Community Strikes do.  (again, this is from personal experience).

I think this part of the act is what people are using to upload full covers and things to youtube, right?

In other words, short clips and stills can be used for teaching (i.e. broadcast to those in a classroom without permission from the owner), reviewing and news reporting to demonstrate the product or media in question.

For example a short clip from queen live at Wembley, giving proper owner and copyright information, can be used in a youtube video where someone is reviewing queen live at Wembley. It’s allowed because it gives a short visual demonstration of what is being talk about.

A small screen grab from the DVD may also be used in a written review about the DVD to demonstrate video quality.

This doesn’t cover uploading full videos for others to enjoy. it should / will only stand up when a short clip is used to give a representation of the media being discussed.

It's seems like a very confused grey area, i guess how legal the clip you use is depends on how powerful the company.

Freddie, plz help us locate DaveRFuller.  His YT account has been pulled, again.  This young man has done more for Queen's legacy than Queen can know.  For five years he has consistently, politely, and fervently worked to produce the most amazing collection of everything Queen.  The youngsters who have learned their appreciation for Queen have gone to Dave's "school."  So many questions he has fielded, the Yankees should sign him.  When I consider the time and effort this fine young man has invested in YT and Queen, it makes my Soul cry for what someone has done to him.  Where is he?  We need DaveRFuller back on YT so I am asking Freddie to help us find him.  Such love for Freddie the young man has.....this is a damn shame.
