they were bootlegged in the beginning - and were illegal then so how is selling them any more illegal?
Yes, you can report him for copyright infringement, although that's generally a last resort.
It's generally accepted that there are (and to a certain extent need to be) bootlegs on ebay - I have bought and sold such. However, this an mp3 converted to CD (which should therefore be stated as such) and it's ALSO generally accepted that while I hold no legal rights to the material AT ALL, if the guy that gave you something asks you not to sell it, you should really respect that.
So we'll see if he takes it down like he's been asked to.

Brenski - forbidden isn't the same as illegal. You're absolutely correct that it's an illegal recording, but bootlegging etiquette (for want of a better phrase) suggests one should respect one's sources - cliff howell for the 46664 DVD, me for the Cardiff recording etc etc.

Checking his posts, he went to Belfast (no sign of him recording, sharing or selling that one) took some photos (which he has shared), and asked for artwork for other people's audio recordings.

Is there a way to let Ebay moderators ban him?
You can write to ebay and have them shut down the auction. It shouldn´t be a problem in this case as he´s obviously selling bootleg cdrs. It would be great if someone could do that, because he will probably continue selling these recordings.
