That is why it is Queen + Paul Rodgers..he's no member of Queen....its Queen+Paul Rodgers and it will never be Queen again!
Although I think we should Brian and Roger use the Queen name as they want (nb: they NEVER inculded Paul in the Queen name, it's Queen+Paul Rodgers for God's sake!), one could argue that although Brian and Roger were at the very start of the band, the name Queen in itself was found by Freddie (even Brian and Roger admitted they weren't really enthusiast about it at the begining)so maybe if Freddie is dead, the name shouldn't be used.
However, I think Roger and Brian who spent twenty years of their life with Freddie, know what they're doing and have the right to use the Queen name even nowadays without John and Freddie. It wouldn't even make sense if they took a new name.
