Even if any of the labels involved did own any copyright, it's not like Roger isn't in the finiancial position to be able to buy back the rights to the sound recordings or licensing. I haven't got any CDs close to hand to check, but Roger def owns the copyright to the sound recordings of Happiness and Electric Fire - so would he really have handed over copyright to record companies for the Cross just a couple/few years earlier?

I agree that there must be ways around it, and am really disappointed, but just relaying the story that has been given by the official channels over the years whenever this has been asked. Although Roger most likely owns the copyright licencing, is there possibly some agreement whereby it was under a further exclusivity agreement with Virgin, EMI and Electrola? The fact that the band didn't have a worldwide or UK deal for BlackRock (and Mad Bad... was also on a German label deal), and Shove It was on a different label again, may causing some issues between the agreeing parties? I don't know (and like you guys am sure they could come to an agreement if they really wanted to), but this could go some way to explaining it.
On a brighter note, there is talk (originating from Spike Edney) that The Cross may reunite for a shows/shows at Xmas 2013 - although they're aiming at a niche market of fans, perhaps that might give the little push needed to round up a The Cross compliation along with unreleased and rare tracks.
